Nothing in these Terms & Conditions affects your statutory rights as a consumer.

2. These Terms
By placing an order through our website, you agree to these Terms & Conditions.
You should also read our:
-
Privacy Policy;
-
Returns & Refund Policy; and
-
Shipping & Delivery Policy.
These policies form part of the information governing your use of our website and purchases from Online Parasols.
3. Who Can Place an Order
You must be at least 18 years old and legally capable of entering into a contract to place an order through our website.
Our website is currently intended for customers purchasing products for delivery within the United Kingdom.
4. Products
We take reasonable care to ensure that product descriptions, photographs, specifications, dimensions and other information shown on our website are accurate.
However, minor variations may occur.
Images are provided to help illustrate products. Colours and appearance may vary slightly depending on lighting, photography, manufacturing variations and the screen or device used to view the website.
Where dimensions are provided, please check them carefully before ordering, particularly for furniture, parasols and other large products.
Unless expressly stated otherwise, decorative items, accessories or other products shown in lifestyle photographs are not included with a product.
5. Product Availability
All products are subject to availability.
Adding a product to your basket does not reserve it.
Although we make reasonable efforts to keep stock information accurate, occasionally a product may become unavailable after an order has been placed.
If we cannot supply a product you have ordered, we will contact you and provide an appropriate refund for any amount already paid for the unavailable product.
6. Prices
Prices displayed on our website are shown in pounds sterling (£).
Unless clearly stated otherwise, prices displayed to consumers include applicable UK VAT.
Delivery charges, where applicable, will be shown separately during checkout before you place your order.
We may change our prices at any time, but price changes will not normally affect an order that we have already accepted.
7. Pricing Errors
We take reasonable care to ensure prices are displayed correctly.
Occasionally, an obvious pricing or technical error may occur.
If we discover an error affecting an order, we may contact you before accepting or fulfilling the affected order.
Where an obvious pricing error has occurred and the price could reasonably have been recognised as incorrect, we are not obliged to supply the product at the incorrect price where the law permits us to correct the error.
If necessary, we will give you the opportunity to proceed at the correct price or cancel the affected order for a full refund.
8. Placing an Order
Our website allows you to review your basket and order information before submitting your order.
Please check your order carefully, including:
-
products and quantities;
-
variations or colours;
-
delivery address;
-
contact information; and
-
delivery option and charges.
After you submit an order, you should receive an electronic acknowledgement.
An acknowledgement that we have received your order does not necessarily mean that we have accepted it.
9. Acceptance of Your Order
A binding contract between you and Online Parasols is formed when we accept your order.
Acceptance will normally occur when we confirm that your order has been accepted for fulfilment or dispatch, depending on the communications generated through our ordering system.
If we cannot accept your order, we will inform you and refund any payment already taken for goods we cannot supply.
Reasons we may be unable to accept an order include:
-
a product being unavailable;
-
payment not being authorised;
-
an error in the price or product description;
-
applicable delivery restrictions;
-
suspected fraudulent or unlawful activity; or
-
circumstances where we are legally unable to supply the product.
10. Payment
Payment must be made using one of the payment methods offered during checkout.
Payments may be processed by Shopify or other third-party payment providers.
By submitting payment information, you confirm that you are authorised to use the payment method supplied.
11. Delivery
Our delivery arrangements are explained in our Shipping & Delivery Policy.
Orders will typically be dispatched within 2 working days, although you should allow up to 5 working days for dispatch.
Dispatch time is separate from the time taken by the carrier to deliver your order.
Heavy and bulky products are available for delivery to Mainland UK only.
Additional geographical restrictions may apply depending on the product, destination and carrier.
Applicable delivery charges will be displayed during checkout.
12. Delivery Information and Access
You are responsible for providing a complete and accurate delivery address.
For large or bulky products, you should ensure that there is reasonable access to the delivery location.
This may include checking gates, paths, entrances, doorways and other restrictions before ordering.
Where reasonable additional costs arise because delivery cannot be completed due to incorrect information or inadequate access within your control, we may charge reasonable additional delivery or return costs where permitted by law.
13. Risk and Ownership
Responsibility for the goods passes to you when the goods are delivered into your physical possession or the possession of a person identified by you to receive them, subject to applicable consumer law.
Ownership of the goods passes to you once we have received payment in full.
14. Your Right to Cancel
If you are a consumer purchasing online, you will normally have a statutory right to cancel your contract within 14 days of receiving the goods.
Further information about cancellations and returns is provided in our Returns & Refund Policy.
For eligible change-of-mind returns, you are responsible for the direct cost of returning the goods to us.
This can be significant for large, heavy or bulky products, so we recommend checking product dimensions and suitability carefully before ordering.
Certain statutory exceptions to the right to cancel may apply to particular products.
15. Faulty or Misdescribed Products
Products supplied by Online Parasols must comply with your statutory rights.
Among other requirements, goods must be of satisfactory quality, fit for purpose where applicable and as described.
If you believe a product is faulty, damaged, incorrectly supplied or not as described, please contact:
Your rights regarding faulty goods are separate from our change-of-mind returns arrangements.
Nothing in these Terms & Conditions limits the rights or remedies available to you under applicable consumer law.
16. Returns and Refunds
Our Returns & Refund Policy explains how to cancel an eligible order, return products and report faulty or damaged goods.
For change-of-mind returns, customers are responsible for the direct cost of returning the goods.
Different arrangements apply where we are legally responsible for return costs, including where applicable for faulty, damaged, misdescribed or incorrectly supplied goods.
17. Product Assembly and Use
Some products may require assembly.
You should follow any instructions, warnings and guidance supplied with the product.
Products should only be used for their intended purpose and in accordance with applicable instructions and safety information.
For outdoor products, appropriate care should be taken in adverse weather conditions.
Parasols and similar products should be closed, secured or stored as appropriate during strong winds, storms or other unsuitable weather conditions.
You are responsible for reasonable maintenance and care of products after delivery.
Nothing in this section limits your rights in relation to a product that was faulty when supplied.
18. Website Availability
We aim to keep our website available and functioning correctly but cannot guarantee uninterrupted access.
We may temporarily suspend, restrict or modify access to the website for maintenance, security, technical or operational reasons.
19. Website Content
The content of this website is provided for general information and for the sale of our products.
You may use the website for lawful personal purposes.
You must not misuse the website, interfere with its operation, attempt unauthorised access to our systems or use the website for fraudulent or unlawful purposes.
20. Intellectual Property
Unless otherwise stated, intellectual property rights in the Online Parasols website and original content created for it are owned by or licensed to us.
You may view and use the website for your own personal, non-commercial purposes.
You must not reproduce, distribute or commercially exploit protected website content without permission except where permitted by law.
21. Our Responsibility to You
We are responsible for losses you suffer that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.
We are not responsible for losses that were not foreseeable when the contract was formed.
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for:
-
death or personal injury caused by negligence;
-
fraud or fraudulent misrepresentation; or
-
breach of your statutory consumer rights.
If you are purchasing as a consumer, we do not exclude or limit rights that cannot legally be excluded or limited.
22. Personal or Business Use
Products sold through the Online Parasols consumer website are primarily intended for personal and domestic use unless otherwise stated.
We are not responsible for business losses, including loss of profit, revenue, business opportunity or business interruption, where you purchase as a consumer and use the goods for commercial purposes that we could not reasonably have anticipated.
This does not exclude liability that cannot lawfully be excluded.
23. Events Outside Our Reasonable Control
We will not be responsible for delay or failure to perform an obligation where this is caused by circumstances outside our reasonable control.
Examples may include severe weather, transport disruption, carrier disruption, industrial action, natural disasters, failure of telecommunications networks or other events that we could not reasonably prevent.
Where such an event materially affects your order, we will take reasonable steps to minimise the effect and communicate with you where appropriate.
Your statutory rights remain unaffected.
24. Personal Information
We process personal information in accordance with our Privacy Policy.
Please read that policy for information about how and why we process personal information and your data protection rights.
25. Changes to These Terms
We may update these Terms & Conditions from time to time.
The terms applicable to an order will normally be those in force when your order is placed.
The latest version will be published on our website together with the date it was last updated.
26. If Part of These Terms Is Invalid
If a court or other competent authority determines that part of these Terms is unlawful or unenforceable, the remaining provisions will continue to apply.
27. Our Failure to Enforce a Right
If we do not immediately enforce a right under these Terms, this does not mean that we have waived that right.
28. Third-Party Rights
These Terms are between you and us.
Except where the law provides otherwise, no other person has a right to enforce these Terms.
29. Governing Law
These Terms & Conditions are governed by the laws applicable in the United Kingdom according to where you live.
If you are a consumer, you retain the benefit of any mandatory protections and rights available to you under the law applicable to you.
Any dispute may be dealt with by the courts that have jurisdiction under applicable UK consumer law.
